you can get spells when you graduate to the next year. Homework absolutely isn't necessary. After June your character will graduate to the next year and you'll be able to put the previous year's spells in your trunk update, along with the extra stat points you'll get .

I have the first and second year spells and I've only ever done one homework assignment - and that was to finish the mentor program

You do, you still have to update your trunk post though to be able to use those spells and such. it doesn't update by itself.
