Does Absence of Evidence Apply?
Katie quietly walked on her ruptured through the hallways. She lived the the of the adrenaline rush she got from staying out past curfew. While she was supposed to be in her bed in the Narcissa Malfoy dorm in the Slytherin dungeons, she was actually enjoying sneaking softly through the corridors. She hasn't been caught yet, and she was confident that she would not run into a prefect. She did not know their exact round times and locations, but Katie assumed that they would be stationed around the common rooms. That meant they would not be able to catch her, because she never officially went into the Slytherin dorms.
She smirked at their incompetence and pulled out a lemon raspberry muffin she had snagged from the breakfast table that morning with a grin. She took a slow bite. Katie really loved these lemon raspberry muffins that the kitchen house elves kept making, and if she ever nonfat one of the Hogwarts kitchen elves, she'd be sure to give him/her a humongous thank you for making such tasty muffins. A few crumbs feel on the fore, but Katie didn't notice those and kept waking softly, but happily and with a smile.

The fourth year was heading through the corridors, his wand at the ready because he knew the Hogwarts castle was not the safest at night. But he was quite old and a prefect so he knew what he was doing more or less. He had cast a Lumos spell and kept it up for his whole patrol and he was not all too long into the patrol when he heard the sound of steps echoing through the empty corridor and he knew they differed from his own steps. He also knew that he would be the only prefect being assigned to this specific area and had to contain a sigh as he quietly approached the student in question. As he got closer he could only make out their silhouette which only told him that she must be female; other than that he was quite sure that he had never met this person before.
"Hey, aren't you supposed to be in bed?" he asked her as he got into talking distance, catching up to her until he easily kept her pace at her side. "Why don't you let me show you back to your common room and we can forget I ever saw you sneaking around past curfew, huh? It's really not safe to be wandering off on your own like this," he offered with an explanation and a calming smile on his face with a slight head tilt, all the while looking approachable and inwardly amused. Alan did not need to enforce good behavior unless given reason to, so a detention was something he would probably only give when he was met with defiance. He truly hoped she would make it easy for him though, it should not be too difficult to head back to one's common room without causing too much drama, right? Tiger was of course with him, perched on his shoulders on top of the cozy winter cloak that he needed since there was not really any way to properly heat the whole castle during the winter months.

Katie was still quite lost in her thoughts, when she heard a unexpected voice: "Hey, aren't you supposed to be in bed?" Katie quickly spun around. She gasped loudly. An older, Gryffindor prefect, who looked like he could be in his third or fourth year was standing there and speaking to her. At first, Katie thought she should dismiss his words. After all, why should she listen to him and go to bed? It wouldn't be as much fun as soaking and exploring the corridors after all.
The older prefect then started speaking to her again: "Why don't you let me show you back to your common room and we can forget I ever saw you sneaking around past curfew, huh? It's really not safe to be wandering off on your own like this,". Katie thought about his words. He had some logic in then. Katie didn't know what might be in the couriers at night, after all. But then again, this was a school. How dangerous could it really be? Katie decided to ask the prefect: "Alright," Katie started, " But first I want to know how it is dangerous. This is a school, so isn't it supposed to be perfectly safe? " Katie reasoned to the prefect. "Besides, I'm having more fun out here than I would In the common room, so what's the problem with what I'm doing?" Katie asked, curiously.

Alan hummed and then shrugged his shoulders. "A friendly duel between two wizards is safe until one of them starts to break the rules,"he explained with a shrug. "What I am saying is that rules are there for a reason and that includes a curfew and as far as I am aware there had been multiple announcements by the Head of Houses as well," he would explain to her. Was that too vague? Alan was however not sure what she intended to hear. He also did not owe her an explanation, all he needed her to do was get back to the dorm so that she could get her required sleep and so that he may continue his patrols before he too could find some well deserved sleep.
He was not sure whether Tiger was still awake, he was pretty calm and quiet on his shoulder, alone the thought of this mighty beast finding some rest as he was wrapped around his neck like a scarf, was enough to warm his heart. "Now.... want to head back to your house?" He would ask the girl with a slight tilt of his head. He really would not want to have to give her a detention of sorts.

Alright! she said, agreeably, with a cheerful smile on her face. But first, wha- she started asking, add though it was some innocent question. Then, halfway through her sentence, she broke into a run in the opposite direction from the prefect. Go to bed and be bored, or stay up having fun? It was really no contest in Katie's mind. She voted to use the aversion to catch the prefect of guard. She noticed a small notebook in the corner. Perfect, she thought to herself. That could be used as a great distraction. "Incindio!" Katie said, aiming her wand at the notebook, silently apologising to whoever's notes they were. Hopefully some random kid she didn't know so she wouldn't have to feel too guilty. This way, hopefully she could get away and escape without having to worry about the prefect catching her. He'd be all caught up in the burning notebook rather than her, and she kept on running, after that brief pause to light the notebook on fire and cause the distraction.

Alan had expected her to go along with it, he had been pretty sure that he had been nice enough for this to work out but apparently niceness was not always the key because she tried to play a silly game, running off into the darkness off the castle. He could not help but sight as he would whip out his wand from its holster and masterfully cast a full body bind curse [d20:20]. He had not expected it to work out and had more relies on luck than actual skill but very luckily chance seemed to be on his side for this one and he watched as the spell took off, catching her in the back and with a inner celebration he would watch as her whole body tensed up and she fell over like a domino stone. With her laying on the ground and unable to run away any further, he would divert his focus to the burning notebook, casting a extinguishing charm [d20:18] on it, knowing that it would be fine he would walk up to where the girl had dropped down. "I tried to give you a chance to get away without detention, but now I am forced to give you one! I will bring you to your common room and you better don't run off this time or I will personally levitate you there," he explained with a sigh and the shake of his head. Why was it that people loved detentions so much? He had always tried his best to get away without! Standing next to her, ready to stop her if she would attempt to flee, he would stop the spells effect on her. Come with me, I will bring you back to the Slytherin common room," he said with a sigh. With that he would escort the girl back to where she was supposed to be.
